TENURE

The land is being offered for sale by private treaty as a whole.

TENANT-RIGHT

All items of tenant-right are included within the sale. The purchaser(s) will not be entitled to claim for dilapidations (if any).

SPORTING & MINERAL RIGHTS

The sporting, mineral and timber rights are included in the sale, in so far as they are owned by the vendor.

WATER ABSTACTION LICENSE

The land has the benefit of a composite water abstraction licence for spray irrigation purposes and will therefore be apportioned on a pro-rata basis across the total licenced area. The purchaser will be responsible for all costs incurred in the transfer of the licence and no warranty or guarantees are given. Further details are available upon request.

SINGLE FARM PAYMENT SCHEME

The vendor has established entitlements under the Single Payment Scheme and will transfer, insofar as it is able, an appropriate allocation of entitlements to the purchaser at the earliest opportunity after completion. Such entitlements may include Set Aside Entitlements and/or Ordinary Entitlements but will specifically exclude any FVP Authorisations. No warranty or guarantee is given to the transfer of Entitlements and will be subject to the approval of DEFRA/RPA. All payments for the 2005/2006 cropping year will be retained by the vendor.

The allocation of Entitlements will be based on National Grid field areas as agreed with the Rural Payments Agency, as opposed to Ordnance Survey field areas as adopted in these sales particulars.
