INTRODUCTION
The Moat Farm Estate is offered for sale on the instructions of the Directors of Kaye Farms (Upend) Limited.

The majority of the Estate is being offered for sale for the first time in over 50 years and offers a rare opportunity in this location to acquire a substantial country residence, two cottages and approximately 205 acres of pasture, arable and woodland either as a whole or in a combination of Lots, all of which is situated in a truly stunning position just 6 miles south of Newmarket.

LOCATION

Situated on the borders of the counties of Cambridgeshire and Suffolk some six miles south of Newmarket in an exceptional location within the hamlet of Upend and being part of the village of Kirtling the centre of which is about one mile distant to the west.

Upend comprises a small community of some thirty dwellings set within a Conservation Area, which together with the long established Fittocks Stud, provides a delightful setting for the Moat Farm Estate the major portion of which occupies the upper valley of the River Kennett. DIRECTIONS
From Newmarket High Street and the Clock Tower take the road to Clare B1063 pass through the villages of Cheveley and Ashley and 1 mile further turn right signposted Upend. Follow the road down through the village pass Fittocks Stud and the entrance to Moat Farmhouse is 200 yards on the left through a brick pier entrance drive.

METHOD OF SALE
The property is offered for sale freehold as a whole or in 6 lots Offers will be considered for any lot or combination of lots. Offers will also be considered for alternative lotting and purchasers should register their interest with the Agents at an early stage indicating the area of specific interest to them.

TENURE AND OCCUPATION
The entire property is offered for sale freehold. At the time of preparing these particulars of sale (October 2008) there were the following occupations.

Gate Cottage - Let to Mr S Morley on an Assured Shorthold Tenancy at a rent of £275 per calendar month.

Ash Tree Cottage - Let on an Assured Shorthold Tenancy at a rent of £300 per calendar month.
Notice to Quit will be served upon these tenants following exchange of contracts.
The arable farmland is currently farmed under a Contract Farming Agreement which will terminate following the 2009 harvest, or earlier by agreement.

TOWN AND COUNTRY PLANNING
The properties are located within East Cambs District Council and are within the designated Conservation Area of Upend. Moat Farmhouse is not listed. Ash Tree Cottage and Gate Cottage are both Grade 2 Listed.

WAYLEAVES, EASEMENTS AND RIGHTS OF WAY
The property is sold subject to and with the benefit of all existing wayleaves,
easements, covenants and rights of way whether or not disclosed. In particular it
should be noted that a public footpath affects Lot 5.
Essex River Authority have an easement (dated 28th April 1971) for a water transfer
pipe across Lot 5.

OVERAGE PROVISIONS
The grain store building is sold subject to an overage provision. In the event that planning permission is granted for a commercial or residential use (excluding any equestrian use) within 21 years of completion of sale, the vendors shall receive 40% of the net increase in value resulting from the granting of such consent. The overage provisions shall be triggered upon the earlier of implementation of planning permission or sale.

MINERAL, TIMBER & SPORTING RIGHTS
All rights are believed to be in-hand and are included in the sale in so far as they are owned.
Although no part of the Estate has been shot over in recent years, the gently undulating terrain and the location of existing woodland belts would seem to offer the opportunity for a purchaser to establish a small family shoot.

SINGLE FARM PAYMENT
The land has been registered on the Rural Land Register with the Rural Payments Agency and has been used to claim Entitlements under the Single Payment Scheme. The Entitlements held for Scheme Year 2007 were as follows:
Normal 72.94 at unit value €331.31 (use by date 2010)
Set-aside 5.69 at unit value €95.13 (use by date 2010)
It is intended that the Entitlements will be transferred to the purchasers within the agreed purchase price and the vendors shall use their best endeavours to transfer such entitlements in accordance with the regulations prescribed by DEFRA and the

RPA.
The vendors shall receive all outstanding payments relating to the 2005 - 2008 scheme years.

VAT
In the event that any sale of the property or any right attached to it become a chargeable supply for VAT the Purchaser shall in addition to the consideration pay to the Vendors the full amount of such tax.

BOUNDARIES
The Vendor and Vendors’ agents will do their best to specify the ownership of boundary hedges, fences and ditches, but will not be bound to determine these. As the property is available for inspection the purchaser(s) will be deemed to have satisfied themselves as to the ownership of the boundaries.
