METHOD OF SALE
The property is offered for sale FREEHOLD as a whole or in 7 lots. Completion of the sale shall be by agreement between the parties.

TENURE AND OCCUPATION
The property is offered for sale freehold with vacant possession on completion with the exception of 4 Maulkins Cottages which is occupied by Mr & Mrs C Palfrey under a Rent Act regulated tenancy at a rent of £160 pcm.
Greenwood Cottage and Numbers 1 & 2 Maulkins Cottages are currently occupied on Assured Shorthold Tenancies and notices to quit have been served on the tenants.
TOWN & COUNTRY PLANNING
The properties are located within St Edmundsbury Borough Council and are located outside of the village development limits of Pakenham.
Dove House is subject to an agricultural occupancy condition that was imposed when planning permission was granted for the property in 1972. The condition states that ‘the occupation of the dwelling shall be limited to a person solely or mainly employed, or last employed, locally in agriculture as defined in Section 221(2) of the Town & Country Planning Act 1962, or in forestry, or a dependant of such a person residing with him (but including a widow or widower of such a person).
Interested parties should satisfy themselves on compliance of the above condition BEFORE submitting an offer for Lot 1.
WAYLEAVES, EASEMENTS, COVENANTS AND RIGHTS OF WAY
The property will be sold subject to and with the benefit of all existing wayleaves, easements, covenants and rights of way whether or not disclosed.
In particular with regard to the private drive forming part of Lot 1:
(a) Lots 2 and 3 (if sold separately to Lot 1) will be granted all necessary rights of way (subject to a contribution for maintenance according to user) together with rights to lay and use services on, under and over the land.
(b) The drive is subject to various rights for adjoining properties.
(c) There is a public bridleway over the driveway.
Lot 7 - there is a right of way for the benefit of the adjoining landowners over the track along the southern boundary.
UPLIFT PROVISIONS
The vendors shall be entitled to 50% of any increased value resulting from the granting of planning permission for a period of 21 years from completion of sale. This uplift clause shall apply to the following properties:
i) Dove House (Lot 1) in the event that any planning consent is granted for development of the land fronting Fen Road.
ii) 3 & 4 Maulkins Cottages (Lot 5) in the event that planning consent is granted for any additional dwellings.
MINERAL, TIMBER & SPORTING RIGHTS
All rights are believed to be in-hand and are included in the sale in so far as they are owned.
SINGLE FARM PAYMENT
Some of the land has been registered for Entitlements under the RPA Single Payment Scheme (Further details available from the agents).
It is intended that the Entitlements will be transferred to the purchasers within the agreed purchase price and the vendors shall use their best endeavours to transfer such entitlements in accordance with the regulations prescribed by DEFRA and the RPA.
The vendors shall receive all outstanding payments relating to the 2005 -2008 scheme years.
VAT
In the event that any sale of the property or any right attached to it become a chargeable supply for VAT the Purchaser shall in addition to the consideration pay to the Vendors the full amount of such tax.
BOUNDARIES
The Vendor and Vendors' agents will do their best to specify the ownership of boundary hedges, fences and ditches, but will not be bound to determine these. As the property is available for inspection the purchaser(s) will be deemed to have satisfied themselves as to the ownership of the boundaries.
